JapaNabor Terms of Service
Note: This English Terms of Service is a reference translation. The official and legally binding version is the Japanese Terms of Service.
Article 1 (General Provisions)
These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for the use of the inbound tourism assistant service “JapaNabor” (hereinafter referred to as the “Service”) provided by 合同会社サカサ (SAKASA LLC) (hereinafter referred to as the “Company”). By using the Service, the user is deemed to have agreed to these Terms.
Article 2 (Definitions)
- “User” means a foreign tourist visiting Japan who applies for and receives tourism support through the Service.
- “Student Assistant” means a foreign exchange student who has entered into a service contract with the Company and provides tourism support under such contract without being under the Company’s employment supervision.
- “Matching” means the Company’s process of selecting a suitable Assistant based on the User’s application and arranging the provision of support.
- “Representative” means the person who applies for the Service when used by multiple persons together.
- “PoC” means that the Service is in a proof-of-concept stage.
Article 3 (Scope of Service)
- The Service provides foreign tourists visiting Japan with language support, accompaniment during travel, and cultural understanding support. The Assistant is not a “National Government Licensed Guide Interpreter.”
- No medical acts, legal or financial consultation, or other specialized acts that fall under the services of a National Government Licensed Guide Interpreter will be performed.
- The Service does not arrange accommodations, transportation, tickets, or other travel services. All arrangements must be made by the User.
- The Service is in the PoC stage and may be changed, suspended, or terminated without prior notice.
Article 4 (User Registration)
- Users must provide accurate information in the manner specified by the Company to register.
- Minors are not permitted to use the Service.
- The Company may refuse or delete registrations if the information is deemed inaccurate or inappropriate.
Article 5 (Fees and Cancellations)
- Users must make advance payment of the fees specified by the Company for the use of the Service.
- Cancellations are permitted up to 48 hours before the start of the Service; thereafter, the full service fee will be charged as a cancellation fee.
- Refunds for cancellations that do not incur cancellation fees will be processed, in principle, within 5 business days.
- Payment platform fees (such as Square) are non-refundable.
Article 6 (Service Guidelines)
- The Assistant is not a licensed professional and will not engage in services as a National Government Licensed Guide Interpreter, travel agent, medical professional, or similar.
- The Service does not arrange accommodations, transportation, tickets, or other travel services. All arrangements must be made by the User.
- The selection of Assistants is made by the Company; Users may not directly appoint or negotiate with an Assistant.
- Assistants may accompany Users in cafes and regular dining establishments; however, Assistants may not consume alcoholic beverages.
- Assistants may not accompany Users to establishments whose primary business is serving alcohol (bars, snack bars, etc.).
- The User shall bear the Assistant’s actual expenses, such as transportation and admission fees, including those for the Assistant, in advance.
- Assistants may not accompany Users to nightlife districts, hazardous areas, operate vehicles, or stay in enclosed spaces.
- If the User is intoxicated, the Assistant may terminate the Service.
- If the User is late to the meeting point, the scheduled service time will not be extended.
- Telephone assistance to hotels or facilities must be made using the User’s device and in the presence of the User.
- The Company shall not be liable for any accidents, theft, injuries, etc. occurring during the Service, except in cases of willful misconduct or gross negligence.
- Even where the Company’s liability is recognized, it shall be limited to the amount of the service fee for the relevant Service.
Article 7 (Handling of Unsuccessful Matching)
- If no suitable Assistant is available, matching will be deemed unsuccessful.
- In such cases, the Company will take one of the following actions:
- Full refund
- Proposal of alternative date/time or language
- Alternative arrangements with the User’s consent
- Other reasonable measures
- The Company will notify the User of the policy within approximately 2–3 business days from the receipt of the application.
Article 8 (Prohibited Conduct)
Users shall not engage in the following conduct:
- Giving money, goods, tips, or food/beverages to Assistants
- Exchanging personal contact information with Assistants (LINE, SNS, etc.)
- Being in enclosed spaces with Assistants (hotels, karaoke rooms, internet cafes, etc.)
- Requesting Assistants to accompany them to nightlife, entertainment, or adult entertainment establishments
- Consumption of alcohol by Assistants
- Providing meals, making purchases on behalf of the Assistant, or offering kickbacks
- Posting inappropriate reviews regarding appearance, gender, etc.
- Taking photos/videos without permission or posting them on SNS
- Referring to or inquiring into the Assistant’s personal information (home address, school, etc.)
- Religious or political solicitation (e.g., encouraging joining specific religious groups or political parties, inviting to gatherings/events)
- Assigning tasks outside the scope of service to Assistants (e.g., moving assistance, personal shopping)
Article 9 (Reviews and Ratings)
- Users may post reviews after the Service via methods designated by the Company.
- The Company reserves the right to delete, request corrections to, or temporarily hide any reviews it deems inappropriate.
Article 10 (Liability and Disclaimers)
- The Company is not responsible for Service interruptions or delays caused by natural disasters, transportation delays, or similar events.
- Except in cases of willful misconduct or gross negligence, the Company will not compensate for indirect damages or loss of profits.
- The Company’s liability, if any, is limited to the amount of the service fee paid, except in cases of willful misconduct or gross negligence.
Article 11 (Group Use)
- The Representative shall inform all accompanying persons of these Terms and obtain their consent.
- The Representative shall be jointly liable for any violations by accompanying persons.
Article 12 (Use for Publicity)
- Photos/videos taken will be used for the Company’s publicity activities only with the User’s prior consent.
- With the User’s prior consent, the Company may quote and use photos/videos posted by the User on SNS.
- Consent must be obtained via a method that leaves a record (e.g., DM, email).
Article 13 (Language of the Terms)
- The official version of these Terms is in Japanese; translations are for reference only.
- The Company is not responsible for translation errors.
Article 14 (Handling of Personal Information)
- The Company will appropriately manage personal information in accordance with its Privacy Policy.
- Data may be stored on overseas servers (e.g., Google, Square).
- The Company may use cookies and analytics tools to improve the Service.
- Except as required by law or necessary for Service operations, the Company will not provide personal information to third parties.
Article 15 (Monitoring and Recording of Chats)
- The Company may monitor and record chats between Users and Assistants to prevent disputes and ensure Service quality.
- Chat records will be stored for 6 months in principle and then promptly deleted.
- If any inappropriate statements or behavior are detected in chats, the Company may issue warnings, suspend use, or take other measures.
Article 16 (Exclusion of Antisocial Forces)
- Users guarantee they are not members of antisocial forces.
- The Company may suspend the Service if it determines a User is part of such groups.
Article 17 (Changes, Suspension, or Termination of the Service)
- The Company may change, suspend, or terminate the Service for unavoidable reasons.
- For paid services, the unused portion will be refunded within a reasonable range.
- If a User violates the prohibited items, if the Assistant’s safety is deemed difficult to secure, or if public order and morals are violated, the Company may immediately terminate the Service without refund.
Article 18 (Governing Law and Jurisdiction)
These Terms are governed by Japanese law, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising hereunder.
